    Pay Range Information:

    Chapman University is required to provide a reasonable estimate of the compensation range for this position. This range takes into account a variety of factors that are considered in making compensation decisions, including experience, skills, knowledge, abilities, education, licensure and certifications, and other business and organizational needs. Salary offers are determined based on the final candidate's qualifications and experience, as well as internal equity and other internal factors. The anticipated pay range is not a promise of a particular wage.

    Job Description Summary:

    The Director of Equal Opportunity (DEO) and Investigations, under the general supervision of the AVP for Employee Care and Recognition is responsible for leading equal opportunity efforts for the University which shall include monitoring and evaluating compliance surrounding equal opportunity laws, guidelines, and policies to ensure that employment practices and contracting arrangements give equal opportunity without regard to protected categories. The incumbent shall Investigate employment practices and alleged violations of laws (Title VII, Title IX, Section 504 of the Rehabilitation Act, and Title II of the ADA) to document and assess all claims against University policies, monitor the implementation and impact of guidelines for nondiscriminatory employment practices, prepares reports related to equal opportunity grievances, interviews parties to verify facts and information to complaints, assess root causes of grievances to determine systematic concerns, interprets civil rights laws and equal opportunity regulations for the University community. The incumbent conducts internal investigations and prepares reports of findings to decision makers, prepares responses to external compliance agencies, provides information, technical assistance, and training to supervisors, managers, and employees. Develops policies and guidelines to ensure compliance with equal opportunity laws. The incumbent has supervisory responsibilities, which includes managing the equal opportunity team.

    Responsibilities:

    Reporting to the AVP for Employee Care and Recognition, the successful Director of Equal Opportunity (DEO) and Investigations will:
    Equal Opportunity and Investigations 60%

    • Administer formal and informal internal complaint and grievance procedure from applicants, University employees, and third parties under (Title VII, Title IX, Section 504 of the Rehabilitation Act, and Title II of the ADA) with regard to allegations of discrimination, including those related to race, color, religion, gender, ethnicity, age, sexual orientation, sexual harassment and any other characteristic protected by law
    • Develop and maintain auditing protocols and controls to measure investigative compliance efforts;
    • Provide periodic and timely updates regarding the status of complaints and investigations in progress to the AVP Employee Care and Recognition and the VP|CHRO. Collaboratively engage with internal stakeholders to provide metrics and updates to senior leadership as required.
    • Coordinate data with external investigation firms handling cases on behalf of the University.
    • Support the Office of Legal Affairs in preparing external responses to allegations of harassment and discrimination.
    • Manage the case management repository.
    • Prepare written reports at conclusion of investigations applying the facts of the case to appropriate policy and make a finding on violation of policy, maintain appropriate records and files. Recommend corrective action where appropriate.
    • Serve as Deputy Title IX Coordinator and ADA/504 Officer assisting with consultations, investigations and record keeping to support the University's investigation efforts.
    • Plan and conduct objective and timely investigations of discrimination, harassment, pay/salary inequity or other claims filed internally or externally.
    • Investigating complaints alleging violations of Section 504 of the Rehabilitation Act /ADA, discrimination based on disability, and disability harassment.
    • Monitor the University's implementation of Title IX compliance in all areas.
    • Oversee the implementation and continued development of case management efforts and investigative tracking mechanism to support grievance metrics.
    • Serve on University committees and participate in strategic planning as appropriate in capacity as DOE to the University's workforce diversification efforts.
    • Manage the Equal Opportunity Investigators.
    • Manage the implementation and updating of the Discrimination, Harassment, and Retaliation Policy and the Sexual Harassment Prohibited by Title IX.
    • Review and evaluate University policies and procedures for EEO/Title IX compliance and provide recommendations as appropriate.
    • Provide counsel to CHRO and the AVP of Employee Care and Recognition in the interpretation and implementation of procedures which support University compliance with employment-based federal and state regulatory requirements including (e.g., pertinent legislation, guidelines, executive orders, and applicable judicial administrative decisions) related to employment.
    Affirmative Action 20%
    • Guide the work of faculty and staff search committees.
    • Assist with internal complaints of discrimination.
    • Assist in developing University policies: interpret Affirmative Action ("AA" or "AAP")/equal opportunity policies and regulation; develop and implement programs to ensure the University's compliance with State and Federal obligations.
    • Develop and conduct programs to educate faculty, staff and students on AA policies and regulations; disseminate information to increase awareness of AA issues.
    • Educate the University community on the University's AAP objectives and the University's commitment to providing a work environment that supports equal opportunity.
    • Conduct AA needs assessment as necessary.
    • Responsible for timely annual completion of the annual AA programming.
    • Responsible for timely filing of the University's Federal AAP and VETS4212 filings.
    • Monitor AAP compliance and report progress to the CHRO and University leadership.
    • Collaborate with HRIS team to determine data needed to build HR metrics for the oversight areas and implement best data collection methods
    • Support faculty and staff development as necessary.
    • Provide mediation and problem-solving facilitation when needed among all constituencies.
    • Serve on committees as requested.
    Diversity, Equity, and Inclusion 10%
    • Support and provide recommendations to VP for Diversity and Inclusion (VPDEI) on issues including recruitment, retention, and campus climate for students, staff, administrators, and faculty.
    • Track, monitor, and evaluate root causes to discern their impact efforts towards diversity and inclusions goals and timetables.
    • Participate in the development and implementation of a comprehensive diversity and inclusion plan for students, staff, administration, and faculty within the University.
    • Collaborate with VPDEI on diversity efforts by assessing campus climate collaborating with various campus constituencies, creating, and implementing programs that support diversity and inclusion, and coordinating the communication of diversity initiatives across campus.
    • Participate on various committees focused on the diversification of the University community.
    Training and Other Development 5%
    • Liaise and collaborate with HR partners regarding assignment of trainings to Faculty and Staff (including student employees and third parties) as identified or requested.
    • Develop and implement effective training programs for University search committees and other recruitment selection processes.
    Project Assignments 5%
    • Special projects as assigned by the CHRO.
    Required Qualifications:
    • Bachelor's degree in a related field of study. Prefer Juris Doctor or advance degree in Human Resources, Public Administration, Business Administration, or other relevant discipline.
    • In-depth knowledge of civil rights laws including Title IX, ADA, VAWA, SB-493, and Title VII.
    • Seven years of professional level human resources related experience or equivalent combination of experience and education.
    • Senior Professional in Human Resources (SPHR) certification preferred.
    • Experience in conflict resolution, investigations, mediation desirable.
    • Demonstrated skills in analytical and critical thinking, organization, prioritization, and time management.
    • Highly skilled in writing and summarizing complex information into comprehensive report formats for decisionmakers.
    • Emotional intelligence with a demonstrated ability to handle extremely difficult or volatile situations/individuals effectively.
    • Demonstrated ability to hold team members accountable to goals and progress.
