- Provide substantive legal and commercial advice on all areas of copyright law relevant to the Company including, but not limited to, copyright termination (sections 203/304), foreign reversion, 1909 Copyright Act, and international copyright.
- Assess and advise on rights, obligations and restrictions around the use of the Company's intellectual property in connection with production of film and television.
- Provide expert guidance on sophisticated copyright and related IP issues associated with entertainment content, including chain of title and production clearance.
- Prosecute domestic trademark applications, and manage trademark enforcement matters, opposition and cancellation proceedings worldwide.
- Draft trademark availability opinions, including title opinions
- Evaluate and respond to various intellectual property claims
- Supervise and/or partner with outside counsel on copyright and related intellectual property litigation.
- Evaluate and counsel clients on issues related to moral rights, neighboring rights and related IP issues.
- Stay apprised of meaningful developments in copyright law and how such developments may affect the Company and media and entertainment industry.
- At least 10 years of relevant, substantive copyright experience.
- Experience in trademark law (clearance, prosecution, enforcement) is also strongly desired.
- Experience as in-house counsel and/or within entertainment industry highly preferred, but not required.
- BA/BS degree
- JD degree from an accredited law school
- Admission to California state bar; must be in good standing
- Strong communication and interpersonal skills; and ability to influence to collaborate effectively are essential.
- Ability to conceptualize and articulate practical and creative solutions to meet business needs and legal requirements.
- Ability to spot and analyze complex issues and devise practical strategies and solutions.
- Extensive experience counseling clients at all levels, and proven ability to become a trusted advisor regarding IP issues.
- Must be able to prepare, negotiate, and interpret agreements and other legal documents.
- Must be able to research legal questions and be able to clearly present complex legal advice in fast-paced environment.
