    Description of Job

    The Office of Human Resources (OHR) conducts all Human Resources services. The purpose of this office is to: classify, recruit, screen, examine, interview and refer candidates to appointing authorities in all correctional facilities and parole offices, hiring; establish staffing patterns and create positions; oversee personal services contract compliance; initiate and update personnel and position records for more than 6000 classified positions including creation and maintenance of accurate payroll data; on-board new staff; oversee employee relations, conflict resolution, and employment litigation/hearings; implement ongoing quality control via employee performance evaluation; and manage labor relations.

    Under the auspices of the OHR, reporting directly to the Director of Human Resources, the primary duties and responsibilities of this position include, but are not limited to:

    • Manage the Labor Relations Unit providing direct supervision of others and serve as a resource and specialist in the professional field of labor relations, ensuring efficient use of resources toward effective collaboration.
    • Provide highly advanced human resource management capacity. Responsible for the requirements of the Colorado Partnership Agreement:
    • Oversee, coordinate, review, and recommend personnel actions in conformity with State and Federal regulations.
    • Oversee large agency wide impact projects.
    • Negotiate the side agreement for the department.
    • Conduct and/or oversee others who conduct objective and thorough internal investigations of grievances and complaints; recommend appropriate action.
    • Develop and implement a structured process within the department which includes processes, procedures, and best practices.
    • Oversee, coordinate, review, and recommend compliance, particularly as it pertains to personnel actions.
    • Interpret, consult and administer contractual provisions.
    • Develop and deliver training on both the Partnership and Side agreements, union, and management practices.
    • Coordinate union Request for Information, maintains statistics on organizing actives and provides quarterly reports to leadership. Provides statistics, reports, and collects data as needed and requested.

    CONSULTATION AND PARTNERSHIPS

    • Utilize substantive knowledge of labor relations and union agreements to guide program development and continued success.
    • Execute and implement guidance and vest in long-term success in meeting agency goals and strategic initiatives.
    • Educate stakeholders on unfamiliar concepts and theories beyond common information or knowledge.
    • Provide individual coaching sessions, if needed, to provide stakeholders with tools to enhance successful outcomes related to Labor-Management relationships.
    • Develop a network of labor relations professionals. Collaborate to ensure best practices and appropriate application of professional principles.
    • Collaborate with the State of Colorado Chief Negotiator, Attorney General's Office and agency leadership, as needed, to resolve complex labor relations issues.

    STRATEGIC PLANNING, REPORTING AND TRAINING

    • Oversee and daily management of projects and assignments in order to maintain transparency, consistency and integrity of data/systems/processes to meet position goals and objectives.
    • Implement and manage reporting systems which may include generation of reports, utilizing relevant databases and programs. Provide comprehensive reporting services to management staff on a regular or as-needed basis.
    • Monitor the unit's progress toward meeting established goals and objectives by compiling, reviewing, and assessing reports and records to identify the cause and impact of delays or other problems.
    • Research and identify challenges and problems, and make recommendations to improve, solve and correct.
    • Report progress toward goals and objectives. Create benchmarks and systems to track and enhance progresses.
    • Evaluate and use resourcefulness to identify strengths, weaknesses, and implement a plan of action for continued improvement.
    • Develop networks, training, and written guidance to communicate and strengthen and involve the HR and labor and employee relations community.
    • Understand, study and integrate a complex system of principles, contracts, and known theories related to the topic into training material.
    • Conduct research and training needs assessments to ensure accuracy and function of data/systems/processes.

    NEGOTIATIONS AND GRIEVANCE PROCESS

    • Review collective bargaining agreements, provide input and consult with management on pathways of agreements for departmental use.
    • Facilitate transactions and/or proper use of systems and processes, coordinating logistical

    resources and support for departmental needs.
    * Oversee and administer the grievance process for Labor Relations matters. Review and evaluate grievances and other conflicts resulting from partnership agreements to determine if contractual violations have occurred and recommend appropriate remedies.
    * Other duties, as needed.

    Minimum Qualifications, Substitutions, Conditions of Employment & Appeal Rights

    MINIMUM QUALIFICATIONS

    Experience: Nine (9) years of professional business experience that includes directly leading Human Resource units and guiding the work of professionals. Must include at least two (2) years experience in Labor Relations.

    Typical elements of labor relations activities include enhancing relationships between management and employees, especially with respect to the collective bargaining agreements, union negotiations, coaching, mediation and conflict resolution. (Part time experience will be pro- rated).

    • OR-

    A combination of related education in Human Resources, Labor Relations, enhancing relationships between management and employees, especially with respect to the collective bargaining agreements, union negotiations, coaching, mediation and conflict resolution and/ or relevant experience in an occupation related to the work assigned equal to nine (9) years.

    Professional work involves exercising discretion, analytical skill, judgment, and personal accountability and responsibility for creating, developing, integrating, applying, and sharing an organized body of knowledge that characteristically is: uniquely acquired through an intense education or training regimen at a recognized college or university; equivalent to the curriculum requirements for a bachelor's or higher degree with major study in or pertinent to the specialized field and continuously studied to explore, extend and use additional discoveries, interpretations, and application and to improve data, materials equipment, applications, and methods.

    • Working knowledge of federal, state, and local employment laws, regulations, statutes, and rules;
    • Ability to read and comprehend the English language;
    • Ability to effectively communicate fluently in English both verbally and in writing;
    • Ability to work in a fast paced, quickly changing environment.

    Preferred Qualifications: (Candidates may receive higher ratings for possessing the preferred qualifications criteria.)

    • Experience managing labor relations in a government or corrections setting;
    • Experience in Human Resource management, specifically in supervising HR staff or functions;
    • Experience developing curriculum or training on labor relations topics;
    • Experience advising management on best practices;
    • Demonstrated success with the duties listed in the Description of the Job section.

    • Successfully pass all modules of the Colorado Department of Corrections Basic Training, to include English reading comprehension, relevant competency assessments and written/practical exams in Defensive Tactics;
    • Possess the physical ability to successfully complete Defensive Tactics;
    • Lift arms above head and kick as high as own waist;
    • Stabilize another person to accomplish a controlled take down;
    • Use arms, palms of hands, shins, and feet to deliver blows;
    • Withstand impact (slow speed or with a safety bag) on own body from strikes/blows;
    • Swing a baton in a striking technique;
    • Rotate body 90 degrees with feet planted for striking with foot or using a defensive tactic;
    • Get down on one or both knees and up again with multiple repetitions;

    Will be exposed to Oleoresin Capsicum during Basic Training and will be exposed while on assignment;

    Must be able to see and hear in order to observe, address and respond to potential breaches in safety and security;

    Seize, hold, control or subdue violent or assaultive persons and defend oneself or others to prevent injury;

    Demonstrate body agility, strength of all four limbs and the ability to walk and climb stairs consistently;

    Work in situations involving assaultive behavior, physical control of another person and/or restraint situations;

    Deal with individuals with a range of moods and behaviors, utilizing tactfulness and a congenial, personable manner;

    Work with people of the opposite sex, diverse racial ethnic groups, mentally ill and emotionally disturbed offenders;

    Communicate by talking, listening and/or signaling people to convey or exchange information, assignments;

    Work in an environment with fluctuating noise and temperature (hot and cold) which may include working outdoors in inclement weather and/or concrete floor/wall work settings;

    Willing and able to travel;

    Willing and able to work various shifts, days, afternoons, graveyards (nights) which includes a rotating shift schedule;

    TB (tuberculosis) screening is required of all new employees upon hire;

    Employees may be required to submit to regular serial testing and reporting for COVID-19.

    Successful completion of a background investigation is required. Should applicant's background reveal criminal charges, it shall be the responsibility of the applicant to provide the Department of Corrections with written/official disposition of any charges.
