Job Overview:
Pre-Litigation Tasks
-
Create New Files in CLIO:
- Open CLIO.
- Create a new case file for each new case.
Log New Cases in Spreadsheet:
- Open the Google Sheets document for case tracking.
- Enter the details of each new case in the appropriate fields.
Purchase Police Reports:
- Order necessary police reports online or through the appropriate channels.
Send Out Letters of Protection:
- Draft and send Letters of Protection to medical providers.
Respond to Treatment Inquiries:

Review Files Post-PD Completion:
- Ensure the following:
- Signed rejections (if any)
- Declarations pages
- Acknowledgement letters
- Denial letters
- Updated CLIO information
- Deductible reimbursement
- Final PD documents
Client Treatment Follow-Up:
- Regularly check in with clients about their treatment status until completion.
Medicaid/Medicare Review:
- Assess files for Medicaid/Medicare involvement.
Send LORs to Medicaid/Medicare:
- Prepare and send Letters of Representation if required.
Respond to Lien Notices:
- Send LORs to companies that have sent lien notices or information requests.
Request Medical and Billing Records:
- Obtain medical records and billing with necessary affidavits.
Pay for Records Invoices:
- Process payments online or prepare checks for records invoices.
Prepare and Send Demands:
- Draft and send demands for 3P, UM/UIM, and PIP.
- Log these demands in Dave's settlement board.
Update Settlement Board on Initial Offer:
- Record initial offers received in Dave's settlement board.
Request and Process Releases:
- Request releases from insurance companies.
- Send releases to clients for signatures.
- Forward signed releases with drafting instructions to insurance.
Minor Settlements:
- Ensure GAL assignment and follow up.
- Send all settlement information to GAL.
Draft Settlement Checks:
- Prepare settlement checks.
Prepare Settlement Folders:
- Compile necessary documents into settlement folders.
Distribute Funds to Clients:
- Schedule appointments for clients to pick up funds or arrange for mailing.

Send Citations to Sean:
- Forward citations to Sean when ready.
Send Return of Service to Insurance:
Calendar Disclosure and Affidavit Dates:- Record due dates for disclosures and affidavits upon receipt of an answer.
Non-Answer Procedures:
- Send "answer lawsuit" letters to defendants who do not respond.
No Service Procedures:
- Draft and file 106 Motion for substitute service with affidavits from Sean.
Draft and Review Discovery Documents:
- Prepare disclosures, affidavits notices, attorney designations, ROGs, and RFPs.
- Send drafts to Billie/Jeremy for review.
File and Serve Discovery Documents:
- File and serve the finalized discovery documents to the opposing counsel (OC).
Calendar Discovery Response Dates:
- Schedule deadlines for clients to answer discovery requests.
Discovery Response Preparation:
- Arrange client meetings for discovery responses.
Serve Discovery Responses:
- File and serve discovery responses to OC.
Schedule and Notify of Depositions/Mediations:
- Arrange deposition/mediation dates with opposing counsel and clients.
Manage Deposition Transcripts:
- Send deposition transcripts to clients for review and signature.
- Return signed transcripts to the reporting company by the due date.
Calendar Docket Control Orders:
- Track and record docket control orders.
Send Signed Releases:
- Forward signed releases to Jeremy for submission to opposing counsel.
Minor Settlements:
- Follow up on GAL assignment and ensure hearing scheduling.
Draft Settlement Checks:
- Prepare settlement checks.
Prepare Settlement Folders:
- Assemble settlement folders.
Distribute Settlement Funds:
- Schedule client appointments for fund collection or arrange mailing.
