**Responsibilities:**
ENRD requires support in conducting comprehensive searches into the various conveyance documents that predecessor railroad entities obtained to construct, operate, and maintain railways. ENRD requests a Law Clerk with Title Examiner experience or background in real estate records. The Clerks principal responsibilities would include locating, retrieving, reviewing, organizing, and summarizing various title documents. Most of these title documents, which show how the railroad acquired its interest in a given rail corridor, were entered into in the late 1800s or early 1900s. These documents typically are handwritten and often contain terminology that differs from modern-day documents. Title documents are obtained from the railroad, the non-profit organization or local governmental entity that has been designated as the operator of the recreational trail, or local county records. Additionally, historical documents and maps are obtained from the National Archives Records Administration (NARA) and other parties. The Law Clerk is expected to contact each of these sources and retrieve documents related to landowners claims. Frequently, these documents can be obtained from county offices or from the current railroad company without the need for travel. However, periodic trips to the NARA facilities in College Park, MD, or to the local county offices may be required to manually search and locate relevant documents.
Once documents and related materials are obtained, the Law Clerk will review the materials and work with the assigned trial attorneys to determine the legal significance of each document. Emphasis will be given to the title effect, _i.e._ , fee-simple vs. mere easement, resulting from each (individual) parcels review.
In the course of reviewing relevant title documents, the Law Clerk may prepare Microsoft Excel spreadsheets that summarize the critical contents of the railroad conveyances, including recording information, legal description, and the legal consequences of the document. Additionally, by reviewing existing maps or working in conjunction with the GIS Analysts, the individual would then list those conveyances by the landowners individual parcels. The individual will need to have a strong working knowledge of document management software (such as Relativity) so as to have ready access to the documents summarized in the Excel spreadsheet. This individual must also be able to assist in preparing these documents for use as exhibits for court filings and for trial.
Moreover, the Law Clerk will need to be able to identify 1) gaps in the historical title record relating to a railroads ownership interest, 2) inconsistencies in historic conveyances, and 3) inadequate proof of current landowners ownership of adjoining property. In addition to identifying these deficiencies in the above-referenced Excel spreadsheet, the individual will need to convert these deficiencies into narrative form for the assigned trial attorneys use in communications with opposing counsel and the court.
Furthermore, the Law Clerk will need to analyze attorney fees submitted by opposing counsel, organize the data in an Excel spreadsheet, use macros, and compile or assist in compiling objections to submissions on behalf of the United States.
**Required skills:**
+ Must have law degree or, for some tasks, comparable combination of education and experience may be acceptable.
+ Requires experience as a Title Examiner or a background in real estate records.
+ Excellent organization skills. All project related documents and notes must be maintained in an organized system, ready for use and/or production to opposing counsel.
+ Experience as an expert witness is preferred.
+ Must have at least two to three years of progressively more responsible experience on litigation support projects including proven capabilities and communication skills to successfully interact with clients and attorneys.
+ Requires sound working knowledge of federal and state court systems, legal research procedures, and legal research resources.
+ Requires excellent written and oral communication skills and thorough knowledge of legal research tools such as LEXIS and Westlaw.
+ Must have hands-on familiarity with a variety of computer applications, including word processing, databases (such as document review and file management systems), spreadsheets, and imaging, e.g., Relativity and Excel. Experience working with GIS software is valued.
+ Role also requires hands-on familiarity with ESI tools and knowledge of e-discovery procedures and resources.
