    Summary

    The Senior Attorney works on legal and policy issues and projects related to consumer protection and community reinvestment laws, regulations, and supervisory matters with some supervision.

    The Senior Attorney prepares legal and policy analyses, recommendations, and other work products and assists in policy formulation.
    Duties And Responsibilities

    Performs extensive legal and policy research and writing on issues related to consumer protection and community reinvestment laws, regulations, and supervisory matters, including identifying legal and policy issues, formulating alternate arguments and solutions, and recommending primary and alternate courses of action.

    Drafts legal analyses, recommendations, and other work products on issues related to consumer protection and community reinvestment laws, regulations, and supervisory matters, such as memoranda to Division leadership and the Board, proposed and final supervisory findings, Federal Register notices, amendments to regulations, official staff interpretations, guidance to supervised institutions and Reserve Banks, Congressional testimony, and analyses of proposed and final legislation and regulatory materials issued by other agencies.

    Engages with internal and external stakeholders and analyzes comments and other feedback from the public and other regulators on proposed regulations and guidance.

    Assists management and other senior staff in developing policy and resolving issues.

    Presents to Division leadership and the Board on proposed and final regulations, supervisory policy initiatives, enforcement actions, and other regulatory and/or supervisory matters.

    Responds to inquiries from Board members, Division leadership, Reserve Banks, other federal and state agencies, Congressional staff, private counsel, and the public.

    Represents the Board at various agency and other meetings and conferences.
    Position Requirements
    Selected candidate will work in the Fair Lending Enforcement Section, which is comprised of attorneys, economists, and analysts.

    The key responsibilities of the Senior Attorney are:

    Provides legal and subject matter expertise for the Equal Credit Opportunity Act and Fair Housing Act regarding supervisory matters and policy issues.

    Makes well-reasoned supervision, enforcement, referral, and policy recommendations to the Section's Managing Counsel.
    Provides leadership within the System and among federal agencies with responsibility for fair lending.

    Participates in developing and conducting fair lending training programs for Division staff, the System's examiners, and other relevant staff.

    Analyzes and develops solutions to policy issues relating to fair lending and other consumer protection laws and regulations.

    Researches and analyzes existing and proposed legislation, statutes, regulations, case law, guidance, studies, reports and industry developments relevant to fair lending and other consumer protection laws and regulations.

    Prepares written work products related to fair lending and other consumer protection laws and regulations, including legal analyses, guidance, and speeches.

    Excellent analytical, interpersonal, and oral and written communications skills are essential. Some domestic travel is required. A writing sample may be required.

    Knowledge/Skill Requirements

    Requires a law degree and bar membership, as well as demonstrated analytical ability and strong oral and written communications skills.

    Requires an expertise in the area of consumer credit and financial services law, normally acquired through at least three years specific, responsible work experience.

    Applies the consumer financial services laws for which the Board is responsible.

    Work requires high degree of initiative and resourcefulness in applying analysis of statutory and regulatory language, as well as relevant Board precedent, to assignments.

    The attorney's demonstrated expertise and experience in various areas of specialization will be extensively utilized in developing solutions to broad legal and policy issues.

    Has developed a thorough understanding of the legal and regulatory requirements applicable to a broad range of issues addressed by the Division.

    Demonstrates ability to assess unusual circumstances, incomplete or conflicting data, and changes in relevant law.

    At this full performance level, the attorney is expected to produce thorough and accurate legal analyses of complex legal and policy issues with little supervision.

    Work affects the financial rights of consumers, the activities of organizations in the financial services industry, and the enforcement of federal laws by the Federal Reserve and other government agencies.

    Frequent contacts with all levels of Division management, staff of other divisions and offices, the Reserve Banks, other government agencies, the public, Congressional staff, and Board Members.

    Purpose of contacts is to disseminate information on assignments in process, to gather information, to respond to inquiries, and to advise on compliance with Board regulations.

    Includes coordinating work with other Board staff and staff of Reserve Banks and, on occasion, with other agencies.
    The attorney is expected to exercise independent judgment and to plan and complete assignments with little supervisory direction.

    Level of substantive expertise and experience allows independent resolution of problems and conflicts and interpretation of relevant statutes and policies without clear-cut precedent.

    The Division of Consumer and Community Affairs (DCCA) has resumed an in-office presence and begun a hybrid work environment that requires employees to be physically present in the office a minimum of 4 days per month.

    This includes a monthly connection day (on a Wednesday).

    On occasion, DCCA employees may be expected to be physically present in the office more than 4 days per month, as required by business needs, but can work remotely the remaining days.
