The Employment Counsel advises Human Resources and management on employment-related legal matters and helps manage and minimize risk of liability in such matters.

The Employment Counsel has a passion for employment law and works proactively and reliably, under tight timeframes and in a fast-paced environment.


JOB DUTIES AND RESPONSIBILITIES:

  • Respond to administrative agency complaints, including EEOC/PHRC complaints, OSHA complaints, DOL complaints and NLRB complaints.
  • Assist with management of employment law litigation matters.
  • Collaborate with internal stakeholders including Senior leadership, management and HR to resolve employment disputes and litigation in a timely, costeffective manner
  • Assist in preparing and/or reviewing responses to wage garnishments, subpoenas and related agency and courtordered document requests.
  • Review, develop and update separation agreements for transitioning employees and other employmentrelated agreements.
  • Coordinate and develop unemployment Compensation responses and strategy, prepare witnesses and represent the organization at hearings or in appeal proceedings.
  • Provide daytoday proactive employment law advice, assistance and counseling to Human Resources leaders and management for the entire employee life cycle, including preemployment physicals and background checking, hiring, evaluations, disciplinary actions, termination, requests for accommodation, leaves of absence, wage and hour, and verifications and references.
  • Work with Human Resources to help manage and respond to employee relations issues and investigations, including harassment and discrimination complaints and those relating to employee misconduct.
  • Stay abreast of developments in labor & employment law and recommend, implement, and continuously improve employment lawrelated training on emerging issues and trends as well as "nuts and bolts" training for HR and management as needed.
  • Research, advise and establish eligible outofstate workfromhome arrangements in partnership with Human Resources.
  • Review Network policies, procedures and practices, and recommend enhancements thereto; partner with Human Resources to develop policies and processes to minimize legal risks and ensure best practices.
  • Provide guidance and support to HR professionals and management on the interpretation and enforcement of signon, retention bonus and tuition assistance agreements and related legal obligations.)
  • Maintain confidentiality of all materials handled within the Network/ Entity as well as the proper release of information.
  • Comply with Network, HR and Legal Services policies and procedures

OTHER FUNCTIONS:

  • Assist in other HR and legal matters and projects as needed and other duties as assigned.

PHYSICAL AND SENSORY REQUIREMENTS:
Sitting for up to six hours per day, one hour at a time. Standing for up to five hours per day, one hour at a time. Walking up to three hours per day, thirty minutes at a time. Fingering and handling frequently. Twisting and turning of hands occasionally. Lifting and carrying up to ten pounds, occasionally. Pushing and pulling up to 50 lbs. occasionally. Occasionally stoops, bends, squats, kneels, and reaches above shoulder level. Hearing as it relates to normal conversation. Seeing as it relates to general, near and visual monotony.

Employees who work in patient care areas where they may have potential exposure to patients with suspected or proven tuberculosis (TB) must have the ability to wear a particulate respirator and be fit-tested in compliance with the current recommendations from the CDC (enforced by OSHA) or must provide physician documentation as to the inability to wear a particulate respirator.

MINIMUM QUALIFICATIONS

EDUCATION:
Juris Doctor required from an accredited law school. Admission to Pennsylvania bar required and admission to New Jersey bar preferred.


QUALIFICATIONS:

  • Minimum of five (5) years of experience focused on employment law and litigation, preferably with some experience inhouse.
  • Excellent knowledge and understanding of federal and state employment laws and regulations
  • Excellent analytical, research and writing skills
