    Brief Summary of Job Duties

    Under the general direction of the Director of International Students and Scholars, the Assistant Director, International Scholars, is responsible for utilizing advanced knowledge of various federal programs, immigration policy, and OISS services to effectively serve the UCSB Scholar and international employee population.

    Overseeing and advising on the preparation and submission of documents for the following non-immigrant visa classifications: permanent resident petitions, H-1B Temporary Worker status, TN (NAFTA) Business Professional status, E-3, and J-1 temporary worker for faculty, academic researchers, and professional staff.

    Supervise 2.0 FTE Career staff who provide complex advising, programming, and other immigration services to UCSB's J-1 and H-1B Scholar population.

    Maintain expert level of knowledge on immigration-related policies in order to ensure compliance and effectiveness in scholar advising. Oversee the advising of scholars and dependents with regard to immigration-related employment regulations.

    Serves as the primary resource and contact for academic departments, organized research units, national research centers and the UC systemwide Education Abroad Program Office for the hosting and/or hiring of non-U.S.

    citizens in academic titles and some special staff titles.

    Maintains current knowledge of complex immigration regulations, federal laws and processes, and campus regulations to develop, recommend and implement policies and procedures to successfully obtain immigrant and nonimmigrant employment and researcher status for university employees, and ensure campus compliance with immigration laws and regulations.

    In a cross-cultural environment, counsels foreign visitors, university departments and faculty on non-immigrant and immigrant visa statuses. Plans complex, long-range visa strategy.

    Oversees the preparation and submission of permanent resident petitions, H-1B, E-3, and TN petitions, and the preparation of J-1 documents.

    Maintains Permanent Residency, H-1B, TN, and E-3 databases for non-immigrant university employees. Advises scholars and dependents with regard to immigration-related employment regulations. Analyze and interpret federal immigration regulations and policies in a variety of individual cases.

    Oversees the advising of international employees, faculty and administrative staff about immigration related matters, including decisions about appropriate immigration status options, maintenance of legal U.S.

    immigration status, and assistance in resolving individual employees' immigration-related problems.

    Serves as a Responsible Officer for the J-1 Exchange Visitor Program and as an Authorized Representative of Employer in representing the University to Immigration and the Department of Labor.

    Responsible for ensuring campus compliance with J-1 regulations and employment-based immigration regulations.

    Oversees J-1 advising team, with regard to advising practices, DS-2019 issuance, and compliance with US Department of State J-1 Exchange Visitor Program requirements.

    Oversees H-1B and J-1 training modules for department users, and J-1 orientation for international scholars. Serves as liaison with UCSB's external immigration counsel for legal referrals and case management. Work collaboratively with the Director on department's operations, personnel, budget and mission continuity.
    Required Qualifications
    Bachelor's Degree in related area and/or equiv experience/training at this level
    Experience as DOS-authorized Responsible Officer (RO or ARO) with a J Exchange Visitor program in a university environment
    1- 3 years Experience working with J-1 and H1B visa categories
    Preferred Qualifications
    Fully experienced with immigration policy interpretation to develop & implement & develop processes, esp re: international scholars, with knowledge of academic departments and academic culture especially researchers at a large research university
    Experience with Sunapsis, SEVIS and iCert databases; living, studying and/or working abroad
    Experience as workshop presenter, training, conferences, and other venues
    Special Conditions of Employment

    Must be a citizen or permanent resident of the United States in order to be authorized to use the Department of Homeland Security's Student Exchange Visitor Information System (SEVIS) database.

    May work occasional evenings and weekends.

    • Lead the employment based advising team and the J 1 scholar advising team in serving the international scholar population and interface with campus and UC administration regarding all matters related to international scholar population.
    Exercise sound judgement and discretion to solve problems and make decisions on the Director's behalf to ensure compliance of employees' and scholars' ability to engage in J-1 programs and/or work in the United States. Collaborate with the Director to address international scholar policies and facilitate campus recruitment of international faculty, researchers, and lecturers applying for H-1B status and Green Cards. Maintain relations with US Government agencies including US Citizenship & Immigration Services, US Dept of Labor, Department of Homeland Security, Customs & Border Patrol, and US Department of State for purposes of filing applications and obtaining up-to-date information related to immigration. Utilize NAFSA for professional collaboration and development. Ensure compliance with US Department of Labor for employment-based application requirements. Serve as lead collaborator with campus stakeholders, including Academic Personnel and Office of Research to coordinate campus compliance with employment and export control regulations and policies for international scholars and employees. Oversee training of departmental units and scholars to provide accurate, comprehensible information. Responsible for evaluating scholar application intake process in Sunapsis to ensure accuracy and to capture relevant, necessary information. Evaluate service and delivery of information regarding the campus scholar population and create and implement strategies for improvement and increase efficacy. Promote and facilitate professional development opportunities for scholar advising staff. Represent the department on committees, planning groups, etc. as requested by the Director. Participate in and lead staff meetings and facilitate discussion among staff to resolve and address scholar, program, and administrative issues or problems among staff. Support the director in the oversight of international scholar advising operations. Analyze the needs of scholars, campus administrators, staff, and address software development needs and areas of improvement.

    Oversee and supervise the scholar advising team staff to provide immigration advising and services for J-1 Scholars, Researchers, and H-1B international employees.

    Ensure compliance with governmental regulations pertaining to non-immigration scholars and employees and university policies, systems, and resources.

    Provide training, assistance, and immigration expertise to scholar advising team to guide advising, document production, and auxiliary services to ensure both effectiveness and compliance.

    Hiring of Foreign Research Scholars and Faculty
    Knowledgeable of federal immigration laws, regulations, policies and procedures (Department of Homeland Security, Department of Labor, Department of state), and knowledge of University policies


    This includes:

    • Providing specific and ongoing education and instruction to campus units, and analysis of documentation prepared by campus units for preparing H-1B, TN, and E-3 nonimmigrant petitions.
    • H-1B and E-3 cases: preparing and submit prevailing wage determination requests with Labor Condition Applications (LCA) from the Department of Labor (DOL);
    • H-1B and E-3 cases: obtaining certified

      Serves as the primary resource and contact for academic departments, organized research units, national research centers and the UC systemwide Education Abroad Program Office for the hosting and/or hiring of non-U.S.

      citizens in academic titles and some special staff titles.
    The California State Employment Development Department (EDD). Work with EDD to resolve difficult prevailing wage cases, based on knowledge of UC employment and personnel system, federal (DOL) requirements under the prevailing wage program;

    • Preparing required USCIS forms, letters of support and other required documentation;
    • Submitting H-1B, TN, and E-3 petitions and required supporting documentation to USCIS on behalf of the university
    • Consults with Academic personnel, department chairs and campus administrators about the most appropriate non immigrant visa for an individual given their nationality and previous immigration history in the United States.
    Exercises independent judgement and provides informed advice regarding type of visa or the sequence of visas required for hiring individual within a particular time frame, and where appropriate, assists with obtaining an immigrant status for the individual and immediate family members.

    • Counsels UCSB research scholars and international faculty on procedures for employment at UCSB as well as processing time frames and visa specific immigration requirements and considerations.
    • Gathers and analyzes information from scholars about their field of study and publications in order to frame the strongest case for permanent resident petition.
    • Reviews and submits to USCIS all applications for non immigrant and immigrant visas for academic titles and other eligible individuals on campus.
    • Advises scholars and dependents with regard to immigrationrelated employment regulations.
    • Advises campus administrators about when and how to put a non immigrant on and off payroll and how to deal with benefits.
    • Communicates and works with officials at the Department of Homeland Security, State Department, Department of Labor (DOL), and other Universities to resolve nonimmigrant employment petition issues.
    Recommends and coordinates referrals to designated immigration counsel for cases requiring legal preparation. Facilitates referral process, coordinates filing and document preparation/signing with immigration counsel, and facilitates billing/invoice process for referred cases.

    • Serves as primary campus contact for immigration legal counsel.
    5% Training

    • Trains and provides guidance campus administrators in over 60 academic departments and campus research units in their preparation of the permanent residency petitions, H1-B request form, the Foreign Labor Application Gateway Prevailing Wage Application, the Labor Condition Application and the departments section of the H 1B application.
    • Provides guidance to campus administrators in the preparation of the Labor Certification and H 1B application packets.
    • Provides individual assistance to campus administrators on immigration procedures and visa/employment categories and presents campus workshops on these matters.
    • Provides guidance to campus administrators in the preparation and processing of the prevailaing wage and labor condition applications for the Department of Labor.
    • Oversees the development of a website that provides information to the campus on U.
    S. employment authorization as it relates to employment categories available for UCSB use.

    • Conduct training and informational workshops for campus administrative staff, international students and scholars.
    5% Policies and Procedures

    • Reviews changes in federal regulations related to non immigrant visa statuses (F, J, H 1B, TN, O 1, B 1, B 2, WT, WB).
    Interprets changes in regulations and recommends changes in campus policies and procedures. Writes corresponding directives and instructions for campus units to use.

    • Reviews changes in federal regulations related to immigrant visa statuses obtained through the following categories: outstanding researcher/professor, labor certification, asylum, U.
    S. "green card" lottery, and marriage to U.S. citizen or U.S. permanent resident. Interprets changes in regulations and recommends changes in campus policies and procedures. Writes corresponding directives and instructions for campus units to use.

    • Analyzes and reviews campus policies and procedures for establishing Employment Eligibility Verification, required of all university employees.
    5% Data Collection and Analysis

    • Maintains database for academic employees to track the progression in obtaining the H1B, O1, TN (NAFTA) statuses and ,where appropriate, the permanent residency status, a process that can extend from 1 to 9 years and longer. Responsible for entering critical employmentrelated data in the Department of Labor'sForeign Labor Application Gateway database to produce an approved Labor Condition Application (LCA), required in the filing of an H1B or E3 petitions.
    • Utilize complex database systems to facilitate document production.
