    We have an exciting opportunity for an Employment Law Attorney in Boca Raton, FL


    The Employment Law Attorney at ADMA Biologics will play a pivotal role in providing legal counsel and support on various employment law matters.

    Reporting to the Senior Director, General Counsel, the incumbent will be responsible for advising on employment-related issues and litigation, drafting and negotiating employment-related agreements, reviewing and revising the Employee Handbook and Code of Ethics and Business Conduct, conducting legal research, and ensuring compliance with relevant laws and regulations including multiple state supplements.

    Additionally, the Employment Law Attorney will collaborate with HR and other departments, participate in internal investigations and preparation of related documentation, and support corporate transactions with employment law expertise.

    The Employment Law Attorney will work closely with the Contracts Administrator for support.

    Qualifications


    ESSENTIALS OF THE JOB:

    • Provide legal advice and guidance on all aspects of employment law, including but not limited to, hiring, background checks, termination, discrimination, retaliation, harassment, solicitation, employee benefits, equity incentive plans, workers compensation claims, immigration, reasonable accommodations, Americans with Disability Act (ADA), and wage and hour issues.
    • Draft, review, and negotiate employment agreements, offer letters, severance agreements, equity agreements, employee letter agreements, consulting agreements, third-party recruitment agreements, immigration-related documentation (including engagement letters), payroll-related agreements and other employment-related agreements.
    • Conduct legal research and analysis on complex employment law issues and stay abreast of relevant legal developments.
    • Draft, implement and oversee policies and procedures to ensure compliance with federal, state, and local employment laws and regulations.
    • Collaborate with HR and other departments to provide training and support on employment law matters.
    • Assist in the management of, and participate in, employment-related litigation and administrative proceedings, including drafting pleadings, motions, and other legal documents, attending hearings and responding to discovery requests. Work with outside employment counsel under the direction of the General Counsel.
    • Oversee and manage workers' compensation claims, working with the Company's insurance carrier, outside counsel and Environmental, Health and Safety Department.
    • Assist the General Counsel in managing, renewing and interpreting the Company's insurance policies, and preparing claims as needed.
    • Assist the General Counsel and outside employment counsel in reviewing and amending the Employee Handbook and Code of Ethics and Business Conduct on an annual basis, and coordinating on the rollout to the organization with HR.
    • Participate in internal investigations of employment-related complaints and allegations. Oversee the Company's hotline along with HR.
    • Advise on employee relations matters, including disciplinary actions, grievances, and accommodations. Review/draft corrective actions and performance improvement plans.
    • Collaborate with HR to draft, review and oversee various employee assistance programs, employee benefit plans, employment-related policies, and annual performance review template.
    • Stay abreast of current employee matters and deadlines.
    • Review, respond to and advise on employee-related subpoenas, wage garnishment and other court orders.
    • Support corporate transactions, including mergers, acquisitions, and divestitures, with respect to employment law due diligence, workstreams (e.g., Section 409A and Section 280G) and integration.
    • May be requested to handle other legal matters for the Company as directed by the General Counsel and/or senior management.

    Education Requirements:

    • Juris Doctor (JD) degree from an accredited law school.
    • Admission to the Florida barbar and in good standing.
    • 2-4 years of experience practicing employment law, preferably in a law firm or corporate legal department.
    • Strong knowledge of federal, state, and local employment laws and regulations.
    • Excellent legal research, writing, and analytical skills.
    • Ability to effectively communicate complex legal concepts to non-legal stakeholders.
    • Strong attention to detail and ability to manage multiple priorities in a fast-paced environment.
    • Collaborative team player with a proactive and solution-oriented approach.
    • License(s): License to practice law in the State of Florida through the Florida Bar.

    Additional Experience Information:

    • Experience in the biopharmaceutical or healthcare industry.
    • While a Juris Doctor (JD) degree from an accredited law school is the minimum requirement for this position, candidates with additional education or specialized coursework in employment law or related fields may be preferred.
    • Advanced degrees such as a Master of Laws (LLM) in Employment Law or Human resources Management could provide candidates with a deeper understanding of relevant legal principles and enhance their qualifications for the role.
    • Additionally, completion of relevant certification programs or continuing legal education (CLE) courses focused on employment law may demonstrate a commitment to ongoing professional development in this specialized area of practice.
