My ex-partner and I (we are not married and do not have children) have a shared property in Arganda del Rey (Madrid), with her owning 60% and me owning 40%, which we bought in 2008.

In 2013, we separated and she continued living in the house and taking care of the expenses and mortgage. After 10 years, I have finally convinced her to put the house up for sale. It was not easy, but we have found buyers and signed a sales contract in December. The sale is planned for mid-March 2024.

We have come to the following agreement: I will not receive any proceeds from the sale, and in exchange, she will cover all taxes and charges related to the sale (capital gains, income tax for both of us, mortgage cancellation fees, registration fees, etc.).

The idea is to create a debt recognition on my part towards her for the exact amount I would receive from the sale.

This way, I will not receive anything for tax purposes, and it will not be considered a donation.

We would need to document this situation or explore other ways to carry it out in accordance with the law.
