    Summary

    The Office of Assessments assesses and collects civil monetary penalties for violations of the Mine Act and mine safety and health standards. Including the determination of the civil penalty amounts, collection of and accounting for all delinquent penalties, and tracking all penalty cases in litigation before the Federal Mine Safety and Health Review Commission and the Federal courts. This position is a lead in the Civil Penalty Compliance Division.

    Duties
    • Clarifies provisions of 30 CFR Part 100, discusses violations cited and proposed penalties assessed against violators. Advises mine owners/ operators/contractors of their rights, including the notice of contest provisions, the procedures for informal conferences, and hearing appeals.
    • Researches and reviews information to determine party ultimately responsible for complying with the Mine Act and paying civil penalty assessments.
    • Reviews detailed reports and legal identity information to determine when an operator meets the criteria for further collection activities.
    • Distribute and balance the workload among employees in accordance with established workflow or job specialization, assure timely accomplishment of the assigned workload, and assure that each employee has enough work to keep busy.
    • Processes payments received through the Inter-agency Payment and Collections (IPAC) system. Responds to disputes and/ or compromises received from violators through the Treasury Department. Reconciles debt referred to Treasury but rejected during Treasury processing.
    • Assists district personnel in the full range of hearing request procedures for penalties contested before the Federal Mine Safety and Health Review Commission (FMSHRC), including the recording of FMSHRC decisions in applicable databases. Analyzes decisions and actions taken because of cases being appealed to the FMSHRC; determines appropriate action necessary and performs activities necessary to update systems with appropriate status information, then follows up to ensure timely payments within the time set in the decision.
    • Resolve simple, informal complaints of employees and refer others to supervisor.
    • Reviews and approves or rejects delinquent debt recommended for referral to the Department of Treasury.
    • Serves as personal contact to mine operators, facilitating the collection of proposed assessments for mine safety and health violations.
    • Responds to inquiries from varied sources regarding CPCD policy and procedures.
    • Conduct interviews of internal and external sources to obtain pertinent information.
    • Obtains information and prepares appropriate written replies, including determining and providing appropriate computer-generated report via various modes of communication with operator/contractor, responds to questions related to proposed assessments and collection activities, e.g. notification of payment application, or to obtain additional information to apply payments to specific citations and/ or multiple cases.

    Qualifications

    Applicants must have one year (52 weeks) of specialized experience equivalent to at least the next lower grade level, GS-07 in the Federal Service.

    Examples of specialized experience includes:
    • Interpreting policies and procedures that affect an Organization;
    • Conducting research and analyses of discrepancies in company information and/or in the assessed civil penalties in order to take corrective measures of resolution;
    • Researching, preparing, analyzing and evaluating data and legal documents and case history files to be able to draw conclusions and provide guidance to internal and external stakeholders, as well as maintaining and updating automated database systems;
    • Proficient in the use of computer and software applications in order to updated automated database systems, compile written documents, records and process actions, and produce reports;
    • The ability to lead a team in performing research and analyses of company information (i.e. financial/operational history) and/or in the assessments of civil penalty calculations.
    Specialized Experience is the experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA's) to perform the duties of the position successfully, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level.
