    Duties

    The Special Counsel assists the Clean Energy Counsel in a broad array of tax and management activities associated with the implementation of the clean energy tax provisions of the Inflation Reduction Act of 2022 (IRA 22). The Special Counsel provides technical assistance in efforts to support the Associate Chief Counsel offices with timely implementation of guidance projects and program management related issues arising under the clean energy tax provisions of IRA 22 and the Internal Revenue Code. The Special Counsel is involved with the IRS operating divisions, Treasury officials, and the Chief Counsel Associate for Passthroughs & Special Industries as well as other federal agencies (., Department of Energy, the Environmental Protection Agency, and others) in identifying and resolving operational and legal issues related to the implementation of IRA 22. The Special Counsel provides support to the Department of Justice in lawsuits they are defending and assists in the development and delivery of published guidance, and review of communications documents and training materials related to clean energy.

    As Attorney-Adviser (Tax), you will serve as the Senior Counsel (Clean Energy) and perform the following:
  • As directed by the Clean Energy Counsel, represent Counsel and the IRS on sensitive matters related to the implementation and monitoring of clean energy tax administration programs.
  • Work with Division and Associate Chief Counsel offices in the coordination and direction of activities to support IRS tax administration needs and objectives.
  • Work with the Associate Chief Counsel for Passthroughs and Special Industries Division, to assist in the preparation and review of technical guidance, including drafting regulations, announcements, notices, news releases, revenue rulings and revenue procedures.
  • Coordinate legislative proposals or recommendations about legislation that particularly affects Clean Energy activities.
  • As assigned, acts in an advisory capacity to IRS and Department of Treasury officials, advising them of possible courses of action and the consequences of controversial, complex, or unique problems.
  • Research and develop innovative recommendations regarding the position to be taken by the Office; and upon request from the Clean Energy Counsel, serve as a personal representative on professional legal matters, contribute to the policies and precedents guiding the conduct of legal activities of the IRS and the Department of Treasury.
