Your tasks and responsibilities

Legal clerks work as specialist lawyers at courts and public prosecutors' offices. They carry out their tasks in a professional and independent manner, based on a federal law (Legal Clerk Act). This means that their position is comparable to that of judges. Like judges, they are only bound by their conscience and the law in their decisions and are not subject to any instructions. Their decisions can only be reviewed in the appeal process.

This professional independence sets legal clerks apart from other civil servants. The tasks of legal clerks are diverse and encompass important parts of the legal system. The assigned tasks mainly consist of former judicial tasks.

The following activities are particularly noteworthy:

  • Decisions in land register matters (e.g. on applications for registration of changes of ownership of properties and condominiums or for mortgages and land charges for credit security)
  • Decision on almost all registrations in register matters (commercial, cooperative, matrimonial property, association registers)
  • Issuing of family law approvals
  • Tasks of the family court and guardianship court, in particular the appointment of guardians, custodians and caregivers and monitoring of their activities
  • Tasks of the probate court, e.g. opening of wills and issuing of certificates of inheritance
