Job DescriptionGeneral Description
The purpose of this classification is to provide general guidance for potential candidate(s) and/or employees that are seeking or have been employed by the City of South Fulton (hereinafter "CoSF" or "City") as it relates to providing legal services for the City. The legal services that this classification covers may include, but is not limited to, prosecuting or defending the City regarding pending or current litigation, researching, reviewing and interpretation of the relevant local, state or federal laws, provide legal counsel and advice, to City officials, staff and/or employees, prepare draft and review legal documents and other legal support as required.
Duties and Responsibilities
The job duties and/or responsibilities listed below are merely representative and the City Attorney may assign additional responsibilities as it relates to this position as necessary.
• Assists the City Attorney's Office in representing the legal interest of the City which is comprised of the Mayor, its elected officials, employees and/or departments ("clients") in accordance with local, state and federal laws; provide legal advice; attend meetings; research and write legal opinions, memoranda and other documents that provide clients with legal advice necessary to develop strategies and solutions that are in compliance with and consistent with the City Charter, local, state and federal laws and regulations; draft resolutions and/or ordinances and provides information regarding updated laws and regulations as needed.
• Assists with the handling and managing of litigation that may affect the City and/or its department, including, but not limited to: preparing and responding to interrogatories, requests for production of documents, requests for admissions and other discovery requests; prepare appropriate motions and other necessary pleadings; takes and defends depositions; meets with clients and other witnesses; conducts legal research; assists with determining case strategy; attends mediations, trials, and hearings; argues client's position; makes and responds to legal arguments; may sit as first or second chair at trial; prepares and responds to appellate motions; maintains related documentation and files.
• Assists with drafting, researching and reviewing contracts and agreements to ensure that the City's interest are protected and to avoid potential legal liability and/or exposure; that contracts are in compliance with internal policies and procedures, as well as local, state and federal laws and gives legal advice regarding contract details; maintains related documentation and files.
• May be assigned to represent assigned department in personnel matters, which may include attending and/or presenting evidence and testimony at the hearing or appeals from personnel hearings and other proceedings that are consistent with representing the City's interests.
• Assists in maintaining a comprehensive, current knowledge and awareness of applicable laws, regulations, policies and procedures; maintains professional affiliations, training and continuing education credits and assist or conducts meetings, workshops and seminars as appropriate.
• Assists with the processing of documentation associated with various department(s)/division(s); receives and reviews legal and court documents, legal correspondence, contracts, open records requests, legislation; assists or prepares various forms, reports, correspondence, and other documentation for use in preparation of department reports; and maintains computerized and/or hardcopy records.
• Possesses the requisite knowledge and skill necessary to operate personal computers and office equipment to enter, retrieve, review or modify data, utilizing word processing, spreadsheet, database, presentation, Internet, e-mail, and online legal research.
• Assist the City Attorney's Office in communicating with City officials, supervisor, other employees, clients, court personnel, third party service contractors, the public, and other individuals as needed to coordinate work activities, review status of work, exchange information, or resolve problems.
Additional Functions
May be required to assist or coordinate with paralegals and/or administrative staff.
Performs other related duties as required.
Minimum Education and Experience Requirements:
Requires a Juris Doctorate degree; at least three (3) years of law experience in municipal or local government; three (3) years as a member of the Georgia Bar Association; or any equivalent combination of education, training, and experience which provides the requisite knowledge, skills, and abilities for this job.
Requires membership in good standing in the Georgia Bar Association.
ADA Compliance
Physical Ability: Tasks require the ability to exert light physical effort in sedentary to light work, but which may involve some lifting, carrying, pushing and/or pulling of objects and materials of light weight (5-10 pounds). Tasks may involve extended periods of time at a keyboard or workstation.
Sensory Requirements: Some tasks require the ability to perceive and discriminate visual cues or signals. Some tasks require that ability to communicate orally.
Environmental Factors: Essential functions are regularly performed without exposure to adverse environmental conditions.
