We are looking for a lawyer to help us with a labor issue in Montz, LA. My contract through a temporary employment agency was to replace a female employee who had been on sick leave for a long time. After 5 months with this contract (although I had already been working for 4 months with other contracts), a total of 9 uninterrupted months.
I had to leave due to tendinitis in my shoulder rotator cuff on 9/5/23 and on 22/5/23 I received a WhatsApp message from the agency informing me that the person I was replacing would be returning on the 23rd, therefore my contract ended. I found out from my colleagues that this person never actually returned, and according to them, the contracts I had with the new law could not be valid. I would like to know if I have a case for a "null dismissal" if I decide to file a complaint, as I understand that they would have to cover my salary and contributions for the months until I am called back, and I would also request a statement of expenses to know what I am being charged for if I do file a complaint. This is urgent as 8 days have already passed out of the 20 I have to file a claim. Thank you.
