I have been dismissed from a banking institution where I had been working for one year and one month. My contract started on 06/04/2022 and was supposed to end on 17/05/2023. It was a 6-month probationary contract and on 6 October, I became a permanent employee. The dismissal letter states several reasons for my dismissal and mentions that it has been decided to proceed with my disciplinary dismissal, effective 17/05/23, based on article 71.6. C of the collective agreement (I assume it is for the banking sector) and articles 20 and 58 of the Workers' Statute. I have signed and taken the settlement agreement to the SMAC (Labor Conciliation and Arbitration Service) and tomorrow we have an appointment at the SMAC for a dismissal claim. The agreement states that the bank will compensate me with 4,819 € net for the legal compensation for unfair dismissal and 2,072.30 € for additional compensation. My gross monthly salary was approximately 2,090 €. I have waived my right to take legal action. However, I would like to know if I can file a lawsuit if I do not sign at the SMAC tomorrow. What would be the fees for this, including taxes? Thank you.
