    Overview:
    The United States Patent and Trademark Office (USPTO) is the federal agency for granting U.S. patents and registering trademarks.

    In doing this, the USPTO fulfills the mandate of Article I, Section 8, Clause 8, of the Constitution that the legislative branch "promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries." The USPTO registers trademarks based on the commerce clause of the Constitution (Article I, Section 8, Clause 3).

    Overview:


    Reporting to the General Counsel, the Deputy General Counsel for Intellectual Property and Solicitor (Solicitor) provides the Office of the General Counsel and other USPTO officials with advice in all areas of intellectual property law.

    The Solicitor manages the USPTO Office of the Solicitor and provides guidance to the Deputy Solicitor, Senior Counsels, and Associate Solicitors on litigation and review of patent, trademark, and copyright matters, as well as Office of Enrollment and Discipline (OED) related legal matters.

    The Solicitor will work with the Department of Justice on Supreme Court, Federal Circuit and other matters of critical importance to the Agency as well as working in collaboration with the Department of Commerce on interagency intellectual property law matters.


    Experience:


    The successful candidate will have demonstrated experience in litigating intellectual property cases (involving patent, trademark, copyright, and/or trade secret law) at both federal district and appellate court levels and applying knowledge of intellectual property law in cases involving complex legal and technological issues.

    The successful candidate will also possess experience advancing the policy or business interests of a client through litigation and other advocacy, e.g., by creatively identifying opportunities to raise issues or press claims, and/or by structuring legal strategy to obtain broader goals beyond prevailing on a particular case.

    Bar:
    Currently licensed in good standing to practice law in at least one U.S. jurisdiction.
