    Summary

    The Director-Leglislative Initiatives and Compliance has a significant level of authority for the decision-making, staffing, and budget for their functional area of responsibility, subject to approval regarding the most significant business and policy issues by Senior Management of MTA Construction & Development's Contracts department. Decision-making authority is somewhat defined as the freedom to determine how to accomplish work goals. The Director makes recommendations for policy and procedural changes with final approval from departmental management and supports the implementation of such changes. This position provides input into overall strategy and approach in consultation with departmental management. It supports senior officers within the Department by executing Legislation and Compliance tasks and activities for a designated business unit within the Department.

    Responsibilities

    Supervises preparation of contract documents and updates to ensure that they reflect sound business judgment.

    Ensures version control of contract documents; coordinates and implements revisions to contract documents to ensure consistency and the smooth dovetailing of the various contract documents.

    Supervises training for Contracts Department staff on changes to contract documents to ensure smooth, consistent implementation of new documents.

    Supervises reviews of proposed state and federal legislation and regulations to ensure that impacts on MTA's construction and contracting activities are identified, flagged, and responded to.

    Supervises research on statutes and regulations, utilizing familiarity with NY state statutes and federal regulations that impact construction contracts.

    Supervises preparation of MTA positions and memoranda regarding proposed legislation and regulations.

    Supervises preparation of procedures that guide Contracts staff through the contracting process, exercising sound business judgment.

    Supervises preparation of responses to audits by federal and state agencies as well as internal offices.

    Supervises audits of compliance with procedures by Contracts Dept. staff, including for internal control purposes. Identifies risks vis a vis internal controls.

    Supervises preparation of responses to bid and proposal protests.

    Support management in developing and implementing strategies, solutions, and contracting methods to support departmental goals.

    Analyzes data to identify opportunities to improve the contracting process and plans and implements improvements.

    Other research assignments and projects as required. Provides status updates to management on the relevant tasks and activities.

    Education and Experience

    Bachelor's Degree in Business Administration, Public Administration, Engineering, Economics, Law, Government Contracting, or other related field.

    Juris Doctorate is strongly preferred.

    Must have a minimum of ten (10) years related experience

    Must have a minimum of six (6) years experience in a management or supervisory role.

    Competencies:

    Substantial experience working in and with public sector procurement management principles, government project administration, and government bid process.

    Proven experience working on matters involving public work projects, construction projects, and/or real estate matters.

    Demonstrated ability and experience working with executive management, board members, elected officials, and other government, not-for-profit, or corporate stakeholders.

    Substantial Knowledge of contract terminology, terms and conditions, procurement, and construction management (including construction scheduling).

    Familiarity and experience with relevant local, state, and federal laws, including federal and state procurement laws, rules, and regulations.

    Strong interpersonal, analytical, problem-solving, organizational, negotiation, and communication skills.

    Ability to comprehend, analyze, and interpret complex business documents.

    Proficient in Microsoft Office Suite and document management software.

    Pursuant to the New York State Public Officers Law & the MTA Code of Ethics, all employees who hold a policymaking position must file an Annual Statement of Financial Disclosure (FDS) with the NYS Commission on Ethics and Lobbying in Government (the "Commission").
