SMART Compliance Officer
Reports to: Chief Administrative Officer
Salary (Grade): $31.48 /hr
Status: Reg. Full-Time (Non-Exempt)
Location: Winnebago Police Department, Winnebago NE 68071
Job Purpose & Position Overview:
As the Sentencing, Monitoring, Apprehending, Registering, and Tracking (SMART) Compliance Officer, you will perform a wide range of SMART duties, abilities requiring some independent judgment and on the spot decisions. Will develop and implement special community forums devoted to the Sex Offender Registration Notification Act (SORNA). Will provide community orientation sessions on SORNA. Will provide forums to local residents to address concerns on local law enforcement issues and programs pertaining to SORNA. Will assist Tribal programs, the U.S. Attorney's Office, U.S. Marshals, and the Tribal Court on follow up of individual cases as needed. Will respond to calls concerning SORNA under Tribal, Federal, State and local laws. Incumbent will aggressively enforce all laws and regulations within their authority related to SORNA. May require administering first aid when necessary and other equipment and techniques or as appropriate.
Specific Job Duties/Responsibilities:
- Attend and participate in required SMART/SORNA and the United States Department of Justice (DOJ) training
- Administer first aid when necessary and other equipment and techniques as appropriate
- Develop and implement special community orientation sessions on law enforcement issues and programs pertaining to SORNA.
- Provide community orientations on SORNA involving written and oral presentations to community groups and organizations.
- Work with law enforcement personnel to address community concerns related to SORNA, and review community input for issue resolution where applicable.
- Assist tribal programs and tribal court on follow-up of individual SORNA cases as requested; requests will be reviewed and approved by supervisor before case follow up will begin.
- Respond to calls concerning SORNA under Tribal, Federal, State and local laws.
- Position will serve as the primary point of contact on the Winnebago Tribe of Nebraska reservation to receive and manage Sex Offender Registry information, including monitoring of required reporting, addresses of known sex offenders and a map detailing locations of sex offenders for Police Department use.
- Responsible for oversight of SORNA Exchange portal (i.e. kiosk), including periodic checks to ensure functionality of devises. Ensure records/data made electronically are accessible for inclusion in Winnebago Police Department sex offender registries.
- Knowledge of budgetary practices and procedures
- Ensure Winnebago Tribe Sex Offender Registry website is updated regularly with current reporting information.
- Experienced in the use of computers with standard office software
- Make arrests in Sex Offender violation cases; take persons arrested before the appropriate authority for booking or formal charging; testifies at hearing and trials as an expert witness in Tribal, Federal, State or local courts as required. Prepares and submits police reports, submits daily and weekly activity reports, including narrative and statistical reports, as required.

Special Conditions:
- Will be responsible for fulfilling the objectives stated in the annual work plan as developed jointly by law enforcement and tribal administration and approved through the tribal SORNA grant.
- Coordination, management, and administration of SORNA Project. Shall implement and perform requirements as stated in the SORNA grant
- Shall supervise the SMART Data Entry Office Assistant in required SORNA grant goals and objectives.
- Manages project budget and fiscal responsibilities per Tribal, State, Federal regulations.
- Complete and submit all required grant reports to funder and Tribal Grant and Contract Specialist prior to due dates. Will initiate all data reporting for SORNA as required. Maintain project records and data as required by grantor.
- Process accounts for payable transactions for projects in compliance with Federal Regulations.
- Person appointed must be at least 21 years of age. This requirement may be waived only for veterans.
- Applicant must be able to pass a medical examination and the Physical Efficiency Battery test as a part of a physical condition.
- Provide certificate of release or discharge from active duty for verification of veteran's preference.
- Complete OMB form 1386 Background Survey Questionnaire.
- Applicant is subject to full background check of employment history, criminal records, and FBI files. Applicant must also adhere to Winnebago Tribe of Nebraska drug screening polices,

Physical Requirements of work:
The duties of the position require moderate to arduous physical exertion involving walking and standing, and exposure to inclement weather. Manual dexterity with cooperatively free motion of finger, wrist, elbow, shoulder, hip, knee joints is required. Near vision, glasses permitted, must be acute for the reading of material the size of typewritten characters. The ability of applicants to hear the conversational voice and whispered speech without the use of a hearing aid is required. Since the duties of this position are exacting, responsible, and involve activities under trying conditions, applicants must possess emotional and mental stability. Applicant must have considerable strength and ability to pursue suspects, sometimes on foot; to make and maintain arrests despite possible resistance; to make searches involving traversing difficult terrain under adverse conditions; and to handle other emergency situations. Applicants must be able to defend self and others against physical attack. Applicant must be able to pass a physical examination and the Physical Efficiency Battery test annually as part of a physical examination, any physical condition, which would cause the applicant to be a hazard to themselves or others will disqualify them from employment.
Work Environment:
The environment involves high risks with exposure to potentially dangerous situation, including attack with deadly weapons, or physical attack. Both indoor and outdoor work is involved, including driving and working outside in extreme weather. May be subject to irregular, night or weekend assignments pertaining to SORNA registration activities, as necessary. There is an ever present danger of death or injury from physical assault in the line of duty.
Required Qualifications/Skills:
- Law Enforcement Certification is required
- Completion of an Associate Degree (or working towards degree), in the areas of Criminal Justice, Business Administration, or other related fields.
- Knowledge of police methods and procedures and of the techniques used in police work such as investigation of misdemeanors and minor felonies, investigations, crowd control, riot tactics, and unarmed defense procedures.
- Knowledge of most applicable Federal State Local tribal laws and tribal customs; jurisdictional laws; rules and relationships of the tribe with Federal State and local jurisdiction.
- Basic knowledge of the Constitutional protection afforded to individuals including rules concerning search and seizure, questioning and arrests, the difference between felonies and misdemeanors and between criminal and civil infractions and the procedures for handling suspects.
- Conducts regular inspections of the Department's supplies and equipment
- Skill in interpreting and correctly applying laws, regulations, precedents, and other instructional or informational material to ensure that proper apprehensions are made.
- Basic knowledge of and certification in the use of all firearms used in performing the work of the position
- Thorough knowledge of first aid, including CPR and the use of first aide, including CPR and the use of first aid equipment.
- Must possess a good oral skills and ability to make presentations to large groups and organizations.
- Skill in development and implementation of national community law enforcement and safety programs.
- Analyze data to understand budgetary implication for the SMART program, budget variances and make budget modifications as appropriate
- Must possess a valid state motor vehicle operator's license and have a satisfactory driving record and be must insurable by the Winnebago Tribe of Nebraska's Motor Vehicle Policy background check.
